Careful and careful handling of your personal data is particularly important to us. We therefore process your data exclusively on the basis of the statutory provisions (GDPR, TKG 2003). 1.1 The use of personal data by YOGAMELANGE OG (FN 400251 f) with its registered office in Vienna and business address at Thaliastrasse 2 / 11-12, 1160 Vienna (YOGAMELANGE) is governed by the applicable statutory provisions and the user’s consent to the use of his/her data.

1.2 YOGAMELANGE operates a yoga studio. YOGAMELANGE can be used to book, reserve or purchase various services and products in the field of yoga (collectively the “yoga offer”). The yoga offers are provided by YOGAMELANGE itself. The subject matter of the contract is the use of the YOGAMELANGE services (the “Service”). The YOGAMELANGE services are used by users (the “User”).

1.3 YOGAMELANGE is aware that the protection and careful handling of the user’s personal data is very important. Since YOGAMELANGE attaches great importance to data protection, YOGAMELANGE strictly adheres to the legal provisions applicable in Austria (GDPR, Telecommunications Act (TKG/TMG)) when using this data.

1.4 The user is required to visit the General Terms and Conditions (GTC) of YOGAMELANGE regarding the subject matter of the contract, the obligations of the user, limitations of liability and numerous other important information on the website of YOGAMELANGE under the domain (www.yogamelange.at).

  1. DATA COLLECTION

2.1 YOGAMELANGE collects and stores any information that the user provides on the Eversports platform (“Eversports”) and that is transmitted to YOGAMELANGE in the course of an online booking or that the user provides to YOGAMELANGE in any other way, for example on site. YOGAMELANGE uses the user’s personal data to the extent permitted by law and otherwise only with the user’s consent. Insofar as consent is given electronically as part of an online booking via Eversports, Eversports takes into account the statutory information obligations and logs this consent using suitable technical systems.

2.2 YOGAMELANGE uses the following personal data of the user:

  • Names
  • Booking data (visits)
  • Purchased services/products

  1. PURPOSE OF DATA USE

3.1 We process your data as part of the fulfillment of the contract for the following purposes:

  1. a) For the creation of invoices
  2. b) Storage of open products
  3. c) To create a booking history
  4. d) Information about events, innovations and timetable changes (newsletter)
  5. e) Web analysis (see point 6)
  6. f) Processing of inquiries

You can object to this data processing. If you withdraw your consent, we will no longer process your data for the above-mentioned purposes from that point on. Please note that YOGAMELANGE services can no longer be used in the event of revocation and that the YOGAMELANGE profile must be deleted. To revoke your consent, please contact: info@yogamelange.at.

3.2 If you have subscribed to our newsletter via the registration form on site or via our website, we will process your data to send you our newsletter. For this we need your e-mail address and your declaration that you agree to receive the newsletter. You can cancel your subscription to the newsletter at any time directly via a link in the newsletter emails or by sending an email to: info@yogamelange.at.

3.3 We store your data for the duration of the contractual relationship. Data that is on an invoice or is necessary for invoicing is stored for longer due to the statutory retention period. After the retention period has expired, this data will also be deleted.

  1. DATA SECURITY

4.1 For reasons of data security, personal data is stored in a closed system (Eversports) and protected with a password.

4.2 Eversports is YOGAMELANGE’s data processor and has taken appropriate measures to ensure data security (see: https://www.eversports.at/h/security).

4.3 If YOGAMELANGE becomes aware that the user’s data has been systematically and seriously used unlawfully and the user is threatened with damage as a result, YOGAMELANGE will inform the user immediately.

4.4 The YOGAMELANGE website contains links to other services or websites. YOGAMELANGE is not responsible for the privacy policies and/or practices of other websites. If the user follows the link to another website, the user is solely responsible for familiarizing himself with the data protection provisions of this other website. YOGAMELANGE’s data protection provisions are limited solely to information processed by YOGAMELANGE.

4.5 In addition to Eversports, YOGAMELANGE uses other processors for this data processing. We pass on your data to the following recipients or categories of recipients:

  • Eversports for processing bookings, managing products and cash register.
  • MadMimi for our newsletters
  • CardComplete for processing card payments in the studio on site.

Your data will be processed within the EU/EEA // at least in part also outside the EU/EEA, namely in America. The appropriate level of protection results from an adequacy decision of the European Commission according to Art 45 GDPR, please read the data protection declarations of our providers in detail.

  1. USE OF COOKIES

In order to make visiting our website attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your end device. Some of the cookies we use are deleted again after the end of the browser session, i.e. after you close your browser (so-called session cookies). Other cookies remain on your end device and enable us or our partner companies to recognize your browser on your next visit (persistent cookies). You can set your browser so that you are informed about the setting of cookies and decide individually whether to accept them or to exclude the acceptance of cookies for certain cases or in general. This website uses functions of the web analysis service Google Analytics. The provider is Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Google (Universal) Analytics uses methods that enable your use of the website to be analyzed, such as so-called “cookies”, text files that are stored on your computer. We have concluded a contract with Google for commissioned data processing. As an alternative to the browser plugin, you can click this link to prevent Google Analytics from collecting data on this website in the future. An opt-out cookie is stored on your end device. If you delete your cookies, you will have to click the link again. We use the function “Activation of IP anonymization” on this website. In the case of an on-site booking (entry in the attendance list on site), the user confirms with his/her signature that he/she has read and accepted YOGAMELANGE’s data protection regulations. The user acknowledges that the personal data specified in point 2.2 will be used for the purposes specified in point 3.1.
